Real Estate Ownership laws

Unlike Mexico and many other countries in Latin America, Costa Rican laws do not discriminate against foreigners or non-residents in the purchase and sale of real estate.  Titles to real properties are registered in a government title office in the purchaser’s name. In fee simple.

“Insurance” is reserved for the state owned monopoly, INS. However, Stewart Title Guarantee SA offers a financially backed guaranty of the status of your title.  Title guaranty is a private contract of indemnity between a purchaser and a title guaranty company that protects the beneficiary of the guaranty from issues that may affect the title to the property, issues like liens, encumbrances, fraud, hidden heirs, or improperly executed documents.
